These Terms and Conditions (the "Terms") govern access to and use of the fortuna.fun website, mobile applications, smart contracts, and related services (collectively, the "Platform"), operated by Fortuna.Fun LLC, a company incorporated in the United Arab Emirates (the "Company," "Fortuna," "we," "us," or "our").

By accessing or using the Platform, you agree that you have read, understood, and accepted these Terms in full. If you do not agree, you must not access or use the Platform.

1. ELIGIBILITY

1.1 You must be at least 18 years of age (or the age of majority in your jurisdiction, if higher) to use the Platform.

1.2 You represent and warrant that:

• You have full legal capacity to enter into these Terms;
• Your participation is lawful in your jurisdiction; and
• You are not a resident of, or accessing the Platform from, a jurisdiction where participation in blockchain-based giveaways, promotions, or digital asset activities is prohibited or restricted.

1.3 The Platform is not available to residents or nationals of sanctioned or embargoed jurisdictions, or to any person listed on international sanctions lists, including but not limited to UN, EU, UK, or OFAC sanctions lists.

2. PLATFORM DESCRIPTION

2.1 Fortuna.fun is a blockchain-based giveaway and promotional engagement platform that enables eligible users to participate in promotional campaigns, prize draws, raffles, and skill-based or chance-based distributions using blockchain technology.

2.2 The Platform does not constitute gambling, betting, or a lottery service under UAE law. No purchase is required to enter unless explicitly stated, and any consideration provided is for platform utility or engagement purposes only.

2.3 The Company does not provide investment advice, financial advice, or asset management services.

3. ACCOUNT REGISTRATION

3.1 You may be required to create an account and connect a compatible blockchain wallet.

3.2 You are solely responsible for:

• Maintaining the confidentiality of your wallet credentials and private keys;
• All activity conducted through your account or wallet connection.

3.3 The Company does not custody user funds or private keys and cannot recover lost wallets or assets.

4. GIVEAWAYS, PRIZES, AND DISTRIBUTIONS

4.1 Giveaway mechanics, eligibility criteria, prize descriptions, odds, and distribution methods will be disclosed for each campaign.

4.2 Prizes may include digital assets, NFTs, tokens, physical goods, experiential rewards, or third-party benefits.

4.3 All prizes are provided "as is" with no warranties, unless explicitly stated.

4.4 The Company reserves the right to:

• Modify, suspend, or cancel any giveaway;
• Disqualify participants for suspected fraud, abuse, or manipulation;
• Substitute prizes of equal or greater value where necessary.

4.5 Winners are solely responsible for any taxes, customs duties, or reporting obligations arising from receipt of a prize.

5. NO INVESTMENT OR FINANCIAL PROMOTION

5.1 Participation in giveaways does not constitute an investment, security, or financial product.

5.2 Tokens or digital assets distributed via the Platform:

• Have no guaranteed value;
• Do not represent equity, ownership, or profit-sharing rights;
• May be volatile or illiquid.

5.3 Nothing on the Platform constitutes an offer or solicitation of securities in any jurisdiction.

6. USER CONDUCT

You agree not to:

• Engage in fraudulent, deceptive, or manipulative behavior;
• Exploit bugs, smart contract vulnerabilities, or system errors;
• Use bots, scripts, or automated participation mechanisms;
• Circumvent eligibility or geographic restrictions.

7. INTELLECTUAL PROPERTY

7.1 All Platform content, trademarks, branding, software, and designs are the exclusive property of the Company or its licensors.

7.2 You are granted a limited, non-exclusive, non-transferable license to use the Platform for personal, lawful purposes only.

8. SMART CONTRACTS AND BLOCKCHAIN RISKS

8.1 The Platform relies on third-party blockchains and smart contracts.

8.2 You acknowledge and accept risks including:

• Smart contract bugs or exploits;
• Network congestion or failure;
• Regulatory changes affecting digital assets;
• Irreversible transactions.

8.3 The Company makes no guarantees regarding uptime, security, or error-free operation of blockchain networks.

9. DISCLAIMER OF WARRANTIES

The Platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

10. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

• The Company shall not be liable for indirect, incidental, consequential, or punitive damages;
• Total liability shall not exceed the greater of USD 100 or the amount paid (if any) by you to the Company in the preceding 12 months.

11. INDEMNIFICATION

You agree to indemnify and hold harmless the Company, its directors, officers, employees, and partners from any claims, losses, or damages arising from your use of the Platform or breach of these Terms.

12. TERMINATION

The Company may suspend or terminate your access at any time, with or without notice, if you breach these Terms or applicable law.

13. PRIVACY

Use of the Platform is subject to our Privacy Policy, which forms an integral part of these Terms.

14. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of the United Arab Emirates, as applied in the Emirate of Dubai.

Any dispute shall be subject to the exclusive jurisdiction of the courts of the Dubai International Financial Centre (DIFC), unless otherwise determined by the Company.

15. AMENDMENTS

We may amend these Terms at any time. Continued use of the Platform constitutes acceptance of the revised Terms.
